WERQ TOGETHER Terms of Service

Welcome
Thanks for being here. These Terms of Service explain the rules for using our public websites and the things we offer through them. We have tried to keep them clear. If anything is confusing, email us at legal@werqt.org and we will explain it.
By using our public sites, you agree to these terms. If you do not agree, please do not use the sites.
Who we are
WERQ TOGETHER is a 501(c)(3) nonprofit organization (EIN 33-4679916) based at 5441 S Macadam Ave #4431, Portland, OR 97239.
What these terms cover
These terms apply to our public websites, including werqt.org and its sections (such as prize.werqt.org and tryguide.werqt.org), our community resource directory, and any cosmetic domains that forward to these sites (such as transtown.org and transpdx.org). We call these our “public sites.”
These terms do not cover:
- Our internal staff and partner tools at werqhub.org, which are not open to the public.
- Other organizations’ websites that we link to or list. Their terms are their own.
Who can use our sites
You may use our public sites if you are at least 13 years old. If you are under 18, you need permission from a parent or legal guardian to use the sites and to make any purchase or donation. If you make a purchase or donation, you confirm that you are able to enter into a binding agreement.
Donations
Donations to WERQ TOGETHER are voluntary gifts that support our mission.
- WERQ TOGETHER is a tax-exempt 501(c)(3) organization, EIN 33-4679916. Donations are tax-deductible to the extent allowed by law. We do not provide tax advice, so please consult your own advisor.
- We send a receipt for your donation. For any donation where you receive something of value in return, the receipt will note the deductible portion as required by IRS rules.
- Donations are processed through Squarespace and Stripe. When you donate, you authorize the charge to your selected payment method.
- Donations are generally non-refundable. If you made an error, were charged in error, or see a duplicate charge, contact us at legal@werqt.org and we will work with you in good faith to make it right.
- If you set up a recurring donation, you can cancel future charges at any time by contacting us or using any self-service option provided at checkout.
Purchases and sales
We sometimes sell products and services through our public sites, such as merchandise (for example, t-shirts), the Try Guide, directory or business listings, and event tickets.
Pricing and availability. Prices and availability are shown at the point of sale and may change. We may correct errors, limit quantities, or discontinue an item at any time.
Payment. Purchases are processed through Squarespace and Stripe. When you buy something, you authorize the charge to your selected payment method, and you agree the information you provide is accurate. You are responsible for any taxes that apply to your purchase. Oregon does not have a general statewide sales tax.
Delivery. Digital products (such as a digital Try Guide) are delivered electronically to the email or account you provide. Physical products, such as merchandise, are shipped to the mailing address you provide. Event tickets are delivered electronically and may be required for entry.
Refunds and cancellations.
- Merchandise and physical products: If an item is defective, damaged, or not as described, contact us within 14 days of delivery and we will replace or refund it. We do not otherwise accept returns of undamaged merchandise; those sales are final.
- Digital products (such as a digital Try Guide): Non-refundable once accessed, unless the law requires otherwise.
- Event tickets: Tickets are non-refundable but may be transferable. If we cancel or reschedule an event, you may request a refund or a credit.
- Listings: Paid listings are non-refundable once published. We will work with you to correct errors in a published listing.
Business and directory listings. If you buy or submit a listing, you confirm that you are authorized to represent the business or resource, that the information is accurate, and that you will keep it current. We may edit, decline, or remove a listing at our discretion. A listing is not an endorsement, and we do not guarantee any result, traffic, or outcome from it.
The community resource directory and outside resources
Our public sites include a community resource directory and links to outside organizations. We share these to help our community find support.
- The directory and resources are for information only. They are not legal, medical, housing, financial, or other professional advice.
- We do our best to keep information accurate, but we do not guarantee that any listing is current, complete, or available, and we are not responsible for the services of the organizations we list.
- A listing or link is not an endorsement.
- Please verify details directly with an organization before relying on them, and tell us at legal@werqt.org if something is out of date so we can fix it.
Things you submit
You may be able to submit content to our sites, such as a resource suggestion, a business listing, a message, or feedback.
- You keep ownership of what you submit. By submitting it, you give WERQ TOGETHER permission to use, store, display, and share it as needed to operate our sites and carry out our mission.
- You confirm that you have the right to submit it and that it does not break the law or violate anyone’s rights.
- Do not submit anything false, harmful, harassing, hateful, infringing, or unlawful.
- We are not required to publish or keep any submission, and we may edit or remove content at our discretion.
Acceptable use
When using our public sites, you agree not to:
- Use the sites for any unlawful purpose or in any way that harms others.
- Harass, threaten, or target our community, our staff, our volunteers, or the people we serve.
- Impersonate anyone or misrepresent your affiliation.
- Copy, scrape, harvest, or collect data from the sites without our permission.
- Interfere with the security or operation of the sites, or try to gain unauthorized access.
- Violate our intellectual property rights or those of others.
We serve a community that is frequently targeted for harassment. We may remove content or block access from anyone who uses our sites to threaten or target that community, and we may report unlawful conduct to the authorities.
Our content and trademarks
The content on our public sites, including text, graphics, logos, and the WERQ TOGETHER name and marks, belongs to WERQ TOGETHER or our licensors and is protected by law. We give you a limited, personal, non-exclusive permission to use the sites for their intended purpose. You may not copy, reproduce, or redistribute our content for commercial use without our written permission. Other names and marks belong to their owners.
Disclaimers
Our public sites and everything offered through them are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent allowed by law. We do not warrant that the sites will be uninterrupted, error-free, or secure, or that any resource or listing is accurate or suitable for your situation. Nothing on our public sites is professional advice.
Limitation of liability
To the fullest extent allowed by law, WERQ TOGETHER and its directors, staff, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the public sites, the directory, or anything you buy or submit. To the extent we are found liable, our total liability will not exceed the amount you paid us in the past 12 months, or one hundred dollars ($100) if you paid us nothing. Some states do not allow certain limits, so some of these may not apply to you.
Indemnification
You agree to defend and hold harmless WERQ TOGETHER from claims and costs that arise from your misuse of the public sites, your violation of these terms, or your violation of the rights of others, to the extent allowed by law.
Links to other sites
Our public sites link to websites we do not control. We are not responsible for the content, products, or practices of those sites. Visiting them is at your own risk, and their terms and policies apply.
Changes to these terms and our sites
We may update these terms from time to time. If we make a meaningful change, we will post a notice on this page and update the date at the top. Your continued use of the sites after a change means you accept the updated terms. We may also change, pause, or discontinue any part of our sites at any time.
Ending access
We may suspend or end your access to our public sites if you violate these terms or if we need to for legal or safety reasons.
Governing law and disputes
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. If a dispute arises, we ask that you first contact us at legal@werqt.org so we can try to resolve it directly. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in Multnomah County, Oregon, and you agree to that venue.
The rest
If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and WERQ TOGETHER regarding the public sites.
